A Landmark Cyber Fraud Conviction in Lucknow
In a significant development, a Lucknow court has handed down a seven-year prison sentence to a man for the first-ever conviction related to a “digital arrest” cyber fraud in Uttar Pradesh. This case marks a milestone in the state’s efforts to combat digital crimes and protect citizens from online threats. The trial concluded just 438 days after the initial report, making it one of the swiftest cybercrime trials recorded in the region.
The accused, Devashish Rai, impersonated a Central Bureau of Investigation (CBI) officer and subjected a woman doctor, Dr. Soumya Gupta, to a ten-day campaign of digital intimidation. Using fabricated documents and false identities, he exploited her fear of legal repercussions to coerce her into transferring a total of ₹85 lakh into multiple bank accounts. This fraudulent activity was not only calculated but also highly organized, involving several elements that made it difficult to trace.
The scheme included the use of forged identification documents, fake companies, and the misuse of mobile numbers and SIM cards obtained through deceptive means such as false Aadhaar credentials. These tactics were aimed at creating a sense of legitimacy and urgency, which ultimately led Dr. Gupta to comply with the demands.
The crime came to light on 1 May 2024, when Dr. Gupta reported the incident to the Cyber Crime Police Station in Lucknow. Within four days, the police managed to locate and arrest Rai in Gomti Nagar Extension. The chargesheet was filed on 2 August 2024, just 83 days after the initial report, thanks to the collection of robust digital evidence. The trial was completed on 16 July 2025, culminating in Rai’s conviction and sentencing to seven years of rigorous imprisonment.
The court emphasized that this was a deliberate and well-organized attempt to exploit public fear of government agencies. It underscored the importance of swift and severe punishment in such cases to serve as a deterrent for future digital crimes. The ruling is seen as a positive step towards strengthening the legal framework against cyber fraud and ensuring justice for victims.
