Trump’s Citizenship Case Struck Down as Unconstitutional

For the first time, a federal appeals court has addressed the validity of President Donald Trump’s executive order that sought to deny birthright citizenship to children born on U.S. soil to certain noncitizens — and found it to be unconstitutional, CBS News reports.reported.

The ruling in State of Washington vs. Trump, released on Wednesday, supported the decision of a district court judge who reached a comparable conclusion.

A panel of three judges decided 2-1 that Trump’s order was “invalid as it conflicts with the clear wording of the Fourteenth Amendment, which grants citizenship to ‘all persons born in the United States and subject to the jurisdiction thereof.'”

The sole judge who disagreed with the opinion was Patrick Bumatay, who was appointed by Trump.

Birthright citizenship regulations have led to months of legal battles, along with a separate case where Trump’s Department of Justice sought the Supreme Court’s intervention to restrict lower court judges from issuing nationwide injunctions against executive policies initially.

The highest court, which has recently faced criticism for aseries of under-the-table rulingsto allow Trump to keep eroding the law and the administrative system as legal challenges against his actions move forward, eventuallyagreed to carry this out under specific limited conditionsbut did not comment on the merits of the birthright citizenship order and returned the case to lower courts for further discussion.
