In March, he was expelled alongside numerous suspected members of the Venezuelan gang known as the Trend de Aragua, utilizing President’s powers under the Alien Enemies Act.
The administration was instructed to prepare a status report detailing his “present physical whereabouts and custody situation.” Additionally, they must outline any measures being taken by the government to “assist” with his release from incarceration, along with their plans once he is repatriated.
Rather than adhering to the deadline set for them, government lawyers “merely restated their familiar arguments regarding why they removed Cristian,” as noted by Gallagher, and neglected to furnish any details that the court had requested.
According to Gallagher, administration officials “not only disregard the mandates set forth by this court’s orders… but they also fail to provide any rationale for their evident reluctance to adhere to these directives.”
The government’s reaction “contributes nothing to the established documentation” and shows “no attempt” to adhere to court directives, she noted.
She urged Cristian’s legal team to start “a procedure to establish an adequate record regarding the defendants’ failure to comply with this court’s directives” and granted the administration until Monday to rectify the situation.
