) -24-year-old Victavious Dennis is
charged with the murder
of his four-month-old daughter.
Stephanie and Justin Griffin say their grand-niece, Kyla Jean, spent her last moments fighting for her life alone, without her mother.
“She never got to see her baby take another breath,” Stephanie Griffin said.
The baby’s mother, Madison Posey, tested positive for CBD when she gave birth to Kyla and her twin sister four months ago. She says her doctor recommended taking the CBD to gain weight during the pregnancy.
Because of this, their father, Victavious Dennis, was given temporary full custody, so she wasn’t allowed to see them without him present.
“We would not be sitting here today and getting ready to bury Kyla in the next few days had they not just given those children to him,” Griffin said.
She says her niece went to visit her baby early Sunday morning when she noticed something wasn’t right.
“Her arms were stiff, and she fell to the side, and she said Call 911 right now. What have you done to my baby?” Griffin said. “He said nothing, she’s fine.”
The Griffins believe the ambulance took too long to make it to the hospital.
Once there, they learned baby Kyla had a brain bleed, broken ribs, a broken collarbone, and liver failure. They say it was only there that Dennis said he accidentally dropped her in the bath the night before.
“He was hiding something,” Justin Griffin said. “He was hiding something.”
The Griffins say both siblings, her twin sister and older brother, have had past injuries too that were never explained. They always questioned those injuries and Dennis.
“I think he thought at this time this was going to slip by too, ‘Oh if I own up to it that I accidentally dropped her in the tub giving her her bath, that maybe it would slide by again,” Griffin said.
Their niece was just two weeks away from regaining full custody of her children. But now, they’ve been swept up into the foster care system.
“She looked at her mom and she started crying, she said ‘my kids are with them’,” Griffin said. She’s the innocent party and being treated as the court animal.”
The Griffins blame DHR for initially putting the children in Dennis’ care and say they should be with family members right now. They say nothing will replace baby Kyla Jean.
“We’re never gonna know what she’s gonna look like when she grows up,” Griffin said. “We’re never gonna hear her first words.”
The Griffins tell WAFF that Kyla’s mother now has to go through another program to hopefully get a chance at full custody.
The family has set up a

to raise money for Kyla’s funeral.
