Brazil’s Supreme Court Imposes New Restrictions on Former President Jair Bolsonaro

Brazil’s Supreme Court has taken significant steps against former President Jair Bolsonaro, ordering him to wear an electronic ankle tag and prohibiting him from communicating with foreign officials. This decision comes amid heightened tensions following pressure from former U.S. President Donald Trump, who has publicly supported Bolsonaro in his legal battles.

Bolsonaro, a former army captain turned conservative leader, is currently facing trial for alleged involvement in a military coup attempt during the 2022 presidential election. He is also accused of conspiring to assassinate then-president Luiz Inácio Lula da Silva. If convicted, he could face over a decade in prison.

The court cited concerns that Bolsonaro might attempt to flee the country, given his efforts alongside his son Eduardo—currently residing in the U.S.—to influence the U.S. administration to intervene in his criminal case. The Supreme Court emphasized that there was a “concrete possibility” of Bolsonaro trying to escape.

In response, police conducted a raid on Bolsonaro’s home in a luxury gated community in Brasília, seizing his cellphone and more than $15,000 in cash, most of which was in U.S. dollars. Bolsonaro is now restricted from leaving his home at night or on weekends, banned from using social media, and prohibited from approaching foreign embassies or consulates within 200 meters.

The court accused Bolsonaro of endangering national sovereignty, stating, “National sovereignty cannot, must not, and will never be desecrated, negotiated, or extorted, for it is one of the foundations of the Federative Republic of Brazil.”

Bolsonaro’s legal team expressed surprise and indignation over the measures, claiming he has always complied with authorities. He denies all charges, asserting that he is the victim of a political campaign by da Silva’s government and the courts. During a press conference, Bolsonaro remarked, “Geez, I’m a former president, I’m 70 years old…it’s utterly humiliating!”

Trump recently voiced support for Bolsonaro, suggesting that he would impose a 50% tariff on Brazilian goods starting August 1, citing what he called a “witch hunt” against Bolsonaro. In a letter posted on social media, Trump wrote, “This trial should end immediately!” His intervention has sparked widespread anger in Brazil and increased support for da Silva.

A recent survey by pollster Quaest found that 72% of Brazilians believe Trump was wrong to threaten the tariff, with 79% believing it would negatively impact their lives. Washington responded to the police operation by imposing visa restrictions on Supreme Court Justice Alexandre de Moraes, who has been leading investigations into Bolsonaro.

U.S. Secretary of State Marco Rubio stated that he would revoke the visas of “Moraes and his allies on the court, as well as their immediate family members,” in response to what he called the court’s “persecution and censorship.” Trump’s involvement has complicated Bolsonaro’s legal case further.

The Supreme Court ruled in March that Bolsonaro would go on trial for allegedly plotting a coup after losing the 2022 election. According to investigators, the plan included preparations to assassinate da Silva, Vice President Geraldo Alckmin, and de Moraes, possibly through poisoning or grenade attacks. However, the power grab failed due to resistance from some armed forces leaders.

Bolsonaro, who enjoys strong support among conservatives, farmers, and evangelical Christians, could face significant prison time if convicted. Legal experts suggest that a conviction could result in a sentence exceeding a decade.
